The below French-written paper “Copyright in the digital age: another approach by Elena Debbaut” is investigating the economic impact of the obsolete copyright legislation. The paper is suggesting several reasons and options for the readjustment of the copyright law to the new digital landscape.
This paper will take into account the following aspects:
– the protection provided by some of the most-known licenses
– how the technology is impacting the protection of the copyright
– the mechanism action employed by the copyright trolls
– the impact of monopolies on the creative market
– some ideas for the most suitable copyright solutions in the today’s digital environment.

The reason behind this paper
Today, there is a war going on between the defenders of the old world of the copyright (with its royalties and creative rents) and the new world based on a creative work delivered in a much smaller quantity, but of high quality.
The two worlds are colliding.
Keeping the old system based essentially on creative rents & royalties and the use of the law for malicious purposes is discouraging the new creative work.
Context
All the scenarios described in this document, as well as the technological and economic trends that have triggered them, are the result of my practical experience as founder and operational director of E-GRAPHICS, a multi-channel marketing agency that offers turnkey solutions. Purchased by the number one in the field, I continue to advise various organisations and boards of directors.
Currently, I work as an operational expert in the context of complex strategic missions, such as the recovery of distressed companies and projects.
My humanist, scientific and technical training as well as the almost three decades of professional activity have taught me that companies frequently encounter this type of situation because they cannot perceive all the interactions on the market.
The analysis presented in the below paper is therefore based on an understanding of technology, the humanities, and the economy as a whole. This type of approach is critical because there are not enough people who understand the interactions between these three aspects.
Solutions
A global solution with simplified procedures is the way forward not only for the copyright protection but also for many other areas. A holistic solution should take into account not only the legislative or technical aspect but also the moral and ethical aspects.
So far, all elements (technological, economic, political and legislative) have been able to operate separately.
Technology providers did not interact with politics, let alone the legislators, not to mention the long-term economic thinking.
Each part defended its interests, at the cost of the collective interest. Finally, given the low importance of each of these areas separately, the decisions taken independently had little impact.
Today the world has changed and become more complex, interconnected and globalised – therefore, this luxury is no more justified.
